General Terms and Conditions

These General Terms and Conditions govern the methods of enjoying telematic services for the sale of access tickets by the User (hereinafter also referred to as the "Services" o il "Service", for brevity) aimed at accessing and participating in the event.

The User who uses these Services is required to comply with all the General Terms and Conditions listed herein, which must be read and approved before completing the purchase transaction.

1. Purpose of the Service.

1.1. The Service consists of the online sale of access tickets by MTicket S.r.l. as a Delegate for the sale on behalf of the Event Organizer.

1.2. The issuance of access tickets is done through the MTICKET ver 1.7 platform owned by Marketing Multimedia S.r.l., deemed suitable by the Revenue Agency, in its hardware and software components, for the issuance of access tickets, with provision no. 2022/384751 of October 13, 2022.

2. Definitions.

2.1. 2.1. The following definitions apply to these General Terms and Conditions, with the understanding that plural definitions apply to the singular term and vice versa:

  • Event: indicates the event, show or performance that the access ticket holder can attend.
  • Sales Platform: MTICKET ver 1.7 owned by Marketing Multimedia S.r.l., deemed suitable by the Revenue Agency, in its hardware and software components, for the issuance of access tickets, no. 2022/384751 of October 13, 2022.
  • Sales platform owner: MTicket S.r.l. with registered office at Viale Cassala 36, 20143 Milan - Italy, is the entity appointed by the event organizer to sell access tickets through the sales platform accessible from the website www.italianoperasiena.com (hereinafter Website).
  • User: the individual who purchases access tickets to the Event electronically from the Organizer.
  • Access Ticket Holder: : the individual who legitimately and in compliance with these General Terms and Conditions holds an Access Ticket purchased by the User.
  • Access Ticket: the document issued by the Organizer through the sales platform that authorizes the access ticket holder to enter the Event venue.
  • Contract: the agreement between the User and MTicket S.r.l. and the event organizers that regulates the access ticket purchase process.
3. Access Tickets to the Event.

3.1. Access to the Event is only allowed for Access Ticket Holders.

3.2. The access ticket is personal and not transferable and can be:

  • purchased online, through the sales platform managed by MTicket S.r.l. accessible from the Website
  • purchased on-site, on the day of the Event;

as indicated in the following articles of these General Terms and Conditions.

3.3. In case of purchase from an unauthorized party or in case of lost, stolen, duplicated, or obtained in a manner not compliant with these general terms and conditions, the Access Ticket Holder may not be authorized to access the Event.

3.4. The event will start promptly at the time indicated on the access ticket. Entry during the performance is not permitted.

3.5. The access to children less then three years of age is not permitted

4. Equivalent for the purchase

4.1. The price of the Access Passes varies depending on the type of ticket, the day, and the chosen time slot. In any case, the cost is clearly indicated at the time of purchase and is displayed on the payment summary. Payment by the User is made electronically through a secure virtual gateway.

4.2. The price of the Access Pass may vary depending on the purchase period, at the discretion of the Event Organizer.

4.3. The price of the Access Pass is clearly indicated at the time of purchase, and is expressed in Euros. By entering the quantity of tickets to be purchased, the User immediately sees the price to be paid for the purchase. The amount paid is also stated on the payment summary that the buyer receives via email at the end of the purchase to the email address provided at the time of purchase.

4.4. Following payment, the Payment Service Provider (Nexi Payments SpA, Corso Sempione 55, 20149 Milan) will send an email to the address entered at the time of purchase confirming the transaction.

4.5. Once the order is placed, the User must complete the form in full by entering the required data and making the corresponding payment.

4.6 The Price of Admission Tickets, set by the Organizer and inclusive of any pre-sale fees set and applied by the Organizer ("Pre-sale"), is indicated on the Site in relation to each category of Admission Tickets on the "Tickets" page ("Price of Admission Tickets" or "Price"). The Price is also displayed on the Admission Ticket

4.7 The Price of Admission Tickets, set by the Organizer and indicated on the Site in relation to each category of Admission Tickets, is the last price communicated to MTicket by the Organizer. The Organizer reserves the right to change the Price of Admission Tickets at any time, provided that in the case of purchase through the Site, the price charged to the user will be the one indicated on the Site and in the Order Summary, and any subsequent variations (whether increasing or decreasing) after the order transmission. In particular, any lower price subsequently applied by the Organizer to Admission Tickets of the same type, or with regard to Events to be held on a particular date, will not entitle the Customer to a refund of the difference.

4.8 The Contract is conditionally resolved by the non-payment of the Total Amount. In the event that such payment is not made, the contract will be deemed automatically terminated. The User will be immediately notified of this resolution and the subsequent cancellation of the order, immediately after the order is transmitted through the Site.

4.9 In order to place an order for an Admission Ticket through the Site, the User must carefully read and approve, by selecting the appropriate box provided during the purchase process, the following Terms and Conditions of Sale.

4.10 From the moment the tickets are placed in the cart, the User has 10 minutes to complete the Purchase with payment confirmation. Once the time has elapsed, the tickets will be removed from the cart and be publicly available for sale again.

4.11 At the end of the purchase process, the User will receive from the Organizer, at the email address provided at the time of purchase, a summary email of the purchase made and the Access Pass that must be printed and presented on the day of the Event as a necessary condition for access to the event. Access to the event is also allowed by showing the access pass in electronic format on a smartphone.

4.12. The data collected through the compilation form will be managed in full compliance with the current legislation regarding the processing of personal data, as indicated in the privacy policy.

4.13. Payments will be processed through secure connections, and the data necessary for transactions will be transmitted directly to the payment handler without passing through the servers used by the Organizer or MTicket, therefore the Handler or MTicket is not able to access any sensitive data regarding the transaction, and is unable to intervene in case of a denied transaction for any reason.

4.14. The data controllers are the event organizers.

5. Obligations of the parties.

5.1. The User undertakes to view, read, and accept these Contract Conditions as a necessary condition for purchase, as these clauses are drafted in accordance with Legislative Decree 70/2003 and the provisions on distance selling.

5.2. The sales system will send the User, via email, to the address indicated at the time of purchase, the access title and information related to the purchase with a detailed indication of the price. The User-buyer is required to keep this communication.

5.3 The Access Title is exclusively the access title for the Event for which it was issued, on the day and at the time indicated. The Organizer has the right to refuse access to the Event Venue for irregularities in the Access Title, to perform checks on the person for security reasons, and to verify, by requesting identification, the right to the reduced amount of the access title linked to the age or residence of the user. In the event that the Access Title is found to have been stolen, duplicated, or obtained in violation of these T&C and/or the law, the Holder of the Access Title may not be authorized by the Organizer to access the Event Venue or may be required to leave.

6. Limitation of Liability.

6.1. The event organizers and MTicket S.r.l. are not liable for expenses and/or damages, direct and/or indirect, in any way connected with the sale of access titles and the conduct of the Event.

6.2 MTicket reserves the right to withdraw, modify, suspend, or terminate any function or service provided in relation to the sale of Access Titles, where this is necessary or appropriate for technical and/or organizational reasons, without prejudice to the fulfillment of any Contract already concluded.

7. Event postponed or canceled.

7.1. . In the event of changes in the programming and/or time of an Event, the Holder of the Access Title will have the right to request the replacement of their Access Title or the possible refund of the same.

7.2. In case of cancellation of the Event, the Holder of the Access Title will have the right to request a refund of the ticket cost. The Organizer will proceed with the refund operations according to the most appropriate timing and methods, providing a refund only for the cost of the Access Title, excluding any other applicable costs (such as service fees, shipping costs).

7.3. In any case, the Organizer will not replace the Access Title if it is lost, misplaced, deteriorated, damaged, or destroyed, or if the Access Title is stolen or partially illegible. The Organizer will not replace the Access Title even if the user has purchased a discounted title without meeting the requirements (age or residence) that entitle them to the price reduction.

7.4. In the event of a refund, for any reason, the refund amount will be credited to the same payment method used by the Customer for the initial transaction; if this is not possible, the refund will be made by bank transfer, in which case the organizer will ask the user for the necessary bank details to process the refund.

8. Exclusion of the Right of Withdrawal

8.1 With the payment, the Buyer completes the purchase, accepts, and confirms the content related to the Event. Before completing it, the Buyer agrees to carefully verify all the data related to it (for example: event date, types of seats chosen, and any other details). Such data cannot be changed anymore. In the case of electronic sales, the right to withdraw under Article 59 (exceptions to the right of withdrawal under Articles 52 to 58 of the Consumer Code, paragraph 1, letter n) of the Consumer Code (services related to leisure activities where the contract specifies a specific date or period of execution) is excluded. In this regard, reference is also made to Legislative Decree 22 May 1999, no. 185 art.7 paragraph 1 letter b) and Legislative Decree 06 September 2005 no. 206 art. 55 paragraph 1 letter b) and subsequent amendments. Therefore, no cancellations, requests for partial or total refunds, cancellations, date and time changes, seat and price type changes, for any valid reason, will be possible by the User after completing the purchase.

Specifically, in compliance with current regulations, it is reminded that the sale of access tickets for shows and entertainment involves the issuance of the same tickets (with fiscal seals) simultaneously with payment through a certified and authorized automated ticketing system by the Revenue Agency.

Tickets are valid only for the show date and for the type of seat and price for which they were issued. Therefore, in the event of renunciation, even for any justified and serious reason and/or impediment, on the part of the Buyer to access/participate in the Event, there will be no refund, not even partially, by the Manager, nor of the price related to the event cost, nor of the advance rights, nor of agency fees, as well as of other costs incurred by the Buyer on their own (for example, expenses).

9. Miscellaneous

9.1. These General Terms and Conditions and the information provided in the online ticket purchasing process form the entire contractual agreement between the User and the Organizer. In case of conflict between the provisions of these General Terms and Conditions, as published in Italian, and the corresponding text published in English, as well as in case of conflict with the Italian version and the English version of any other content of the Contract, the Italian version shall prevail.

10. Photography and Video Recording.

10.1. The organizers inform the User/Interested party that during the Event, video recordings, photos, and video interviews will be taken which may be used for non-profit and informational and/or promotional purposes of the event, and for this purpose, they may be published on the website, on the company's websites, on the Owner's social network platforms, in magazines, and on any other dissemination medium used for promotional purposes of the Event.

10.2. By purchasing the Access Pass, the User/Interested party grants a release authorizing the Owner to use such material, with the understanding that consent can be revoked at any time as indicated in the privacy policy.
